Administrative Measures for the Inspection of Fireworks and Firecrackers for Export (Revised in 2018)
Article 1 In order to strengthen the administration of the inspection of fireworks and firecrackers to be exported, ensure the quality of fireworks and firecrackers to be exported, protect the public security and personal safety and promote the development of foreign trade, the present Measures are enacted in accordance with the Law of the People's Republic of China on Inspection of Import and Export Commodities and implementing rules thereof.
Article 2 The General Administration of Customs, P.R. China ("GACC") conducts the uniform administration of the inspection and supervision of fireworks and firecrackers to be exported throughout the country. The competent customs shall be in charge of the inspection, supervision and administration of fireworks and firecrackers to be exported within their respective jurisdictions.
Article 3 The principle of combining the inspection in the place of origin with the inspection at the port shall be followed in the inspection, supervision and administration of fireworks and firecrackers to be exported.
Article 4 The competent customs shall adopt a registration-based management system for the enterprises manufacturing fireworks and firecrackers for export. The conditions and procedures for the registration-based management of manufacturers shall be subject to the Detailed Rules for the Registration of Enterprises Manufacturing Fireworks and Firecrackers for Export.
The competent customs shall file the registered names, registration codes and other information of the manufacturers with the GACC for the record. The marks of the registration codes shall be determined in accordance with the Provisions on Preparation of Marks of Registration Codes of Enterprises Manufacturing Fireworks and Firecrackers for Export.
Article 5 The manufacturers of fireworks and firecrackers for export shall manufacture and store fireworks and firecrackers to be exported in accordance with the United Nations' Recommendations on the Transport of Dangerous Goods-Model Regulations and the relevant laws and regulations.
Article 6 The manufacturers of fireworks and firecrackers for export shall submit the Declaration of Manufacturers of Fireworks and Firecrackers for Export to the customs when applying for the inspection of fireworks and firecrackers to be exported.
Article 7 The inspection of fireworks and firecrackers to be exported shall be conducted in strict accordance with the standards provided for in the state laws and regulations. The inspection shall be conducted according to the standards of the import countries and the trade contracts higher than the standards provided for in the state laws and regulations.
Article 8 The customs shall conduct tests on the safety stability of pyrotechnic compositions for the fireworks and firecrackers to be exported for the first time or whose raw materials or formulas have changed. The fireworks and firecrackers products that are exported for a long term shall be subject to safety performance tests of the pyrotechnic compositions for more than once a year.
Article 9 The transport packing of fireworks and firecrackers to be exported shall bear the packing mark of dangerous goods as provided for by the United Nations and the mark of the registration code of the manufacturer concerned.
The customs shall conduct a usage test on the transport packing of fireworks and firecrackers to be exported and examine whether the name, quantity, specifications and the registration code of the manufacturer indicated on the external packing are consistent with the actual fact. Upon examination, if the aforesaid contents are found to be inconsistent, the goods shall not be discharged.
Article 10 For the fireworks and firecrackers to be exported that have passed the inspection, the Customs shall affix a mark of "inspected" to the obvious part of the transport packing.
Article 11 All the ports and the customs houses in the mainland China shall closely cooperate, jointly check and strength the exchange of information about inspection management and quality of fireworks and firecrackers to be exported.
Article 12 The competent customs shall analyze the quality of fireworks and firecrackers for export within its jurisdiction and report the same to the GACC in written form every year. The GACC will make supervision and selective examination of the inspection, administration and quality of exported fireworks and firecrackers by all customs houses.
Article 13 Whoever violates the provisions of the present Measures shall be given administrative punishments in accordance with the relevant provisions of the Law of the People's Republic of China on Inspection of Imports and Exports and the implementing rules thereof.
Article 14 The documents stipulated herein shall be separately developed and promulgated by the GACC.
Article 15 The power to construe the present Measures shall reside with the GACC.
Article 16 These Measures shall enter into force on January 1, 2000.
